At the meeting, Deputy Director of Customs Control and Supervision Department Tran Duc Hung said, Circular 22/2019/TT-BTC amended and supplemented some articles of Circular 12/2015/TT-BTC specifying procedures for granting customs declaration certificate; granting and revoking code of customs broker staff; procedures for recognisation and operation of customs broker, which will take effect on July 1, 2019 with the spirit of reforming, simplifying administrative procedures and ensuring customs management.
The Circular provides specific regulations, facilitating the business community and contributing to the development of customs brokers. For example, the circular simplifies administrative procedures like cutting business registration procedures in the dossier of recognition of customs broker and identity cards in the application for registration for examination for certificates, issuing code of customs broker staff; specifying administrative procedures for re-issuance, extension and revocation of customs broker staff code.
In the draft circular, risk management in customs operations, including contents on compliance assessment and classification of risk levels for customs brokers, is in line with the reality and the law.
In the framework of the conference, representatives of units presented issues related to customs brokers’operations. Specifically, implementing customs broker contracts according to the scope of agreements in the broker contracts; submitting the contracts to the Customs authority in case of arising violations; Customs brokers only declare after goods owners announce the list of brokers that signed the contracts with goods owners (this operation is compulsory from January 1, 2020), but the Circular also excludes cases that are not required to notify this list.
The Circular also stipulates cases that are suspended from operation such as Customs brokers ineligible for employees, infrastructure, business lines; operate in name and address which have not been recognized; fail to notify the General Department of Vietnam Customs to revoke the code of customs broker staff for staff subject to the revocation; fail to make quarterly reports or make reports with insufficient contents and false time limit in three consecutive times; and customs brokers that make application for suspension from its operation.
Regarding the management and use the code of customs broker staff, Hung said customs broker staff will be granted accounts to access the electronic customs data processing system.
